Best/Worse/What did I learnt today...visit with friends #87

Just spoke to Bernie...

I posted yesterday I believe that he was disappointed at his Monday call to tell him he was not to attend the meeting between his lawyer, their lawyer and the insurance agent..

Late afternoon the insurance agent called to say they were on their way to his house..a few aspects that was not clear to them..they spend 1 hr. at Bernie`s..Bernie had taken over 150 photo`s that cold stormy day so this was beneficial to both lawyers...

Bernie said that the agent went on file to say that she was new to her job, that when they got the policy and said there was a fireplace upstairs and a wood stove downstairs but surrounded by stone enclosure, she marked 2 fireplaces ..insurance unless inspector has approved the woodstove, does not insure them..anyway, during the questioning of this agent it was apparent that an error had been made..insurance lawyer says from the info gathered yesterday the insurance broker should be responsible...now the insurance broker said that if they didn`t insure such stove, why then for the remainder of the 8 month old policy did they continue to insure..why did they just take his money knowing full well if another fire occured they wouldn`t pay out..the insurance lawyer said there was a 2nd issue, when the appraisor came to see the house and all the out buildings he told insurance there was a wood stove in one of the back sheds, contrary again to their policy..Bernie explained that because there was no insurance, he was able to get help both paying for and volunteer and that these people had to come in out of sub-zero weather to warm up and they needed something to cook meals for the crew, Bernie told them he`d take them to see the shed and that the wood stove was no longer there...

After the insurance lawyer left who by the way couldn`t believe the insurance agent admitting possible fault Bernie`s lawyer went on to explain possibilities...he said that things looked good for them and the following could happen...

The booked April 2nd for a hearing, you must have this hearing before you can book court date..

If it goes to trial it would be a jury trial and as he told Bernie, who amongst any of his friends have not heard of some injustices by insurance companies..ie. insurance saying something not covered but yet not explaining non-coverage of certain items... so if it were to go to trial it might benefit Bernie`s case...

I know this sounds like an awful high amount to ask for but they are asking for 1.3 million..cost of repairs to home, stress, loss of credit rating, illness from worrying about losing his home due to high mortgage he had to take etc. etc. but IF they were to offer $500K he`d take it just to close the case and get on with his life...

Now Bernie`s lawyer also said that after the Insurance Broker deposition yesterday, you never know, the insurance might just make an offer...

So prayers do work..know it can go opposite way but it does sound positive...it`s the first time in many months I`ve heard joy in his voice...

My gpa makes those feeders-we don't have any squirrels really, so the last thing I want to do is attract them so they can dig up my bulbs-I have enough trouble with bunnies eating EVERYTHING!!

Sounds better for Bernie..That is a tough thing to go through without the insurance co. being such JERKS.
I never had to experience that.thankfully..I have heard others say what trouble they have had..The one thing most of them said..Take lots of pics..Video better..Wishing the best for Bernie and family

Got this new keyboard all of a sudden like this morning all my sybles are typing in french...funny thing is only on DavesGarden does it do this...drats!

Still blinking from time to time, headache is there but almost gone..brought my excedrin migraine in so all is well..

have to figure out `tubby`how I can type dimensions without the french symbols
