I was always told, "Never loan money to a relative if you expect it back". Absent a contract, one will never really know the "true" intent of the "lender" or "gifter".
I wouldn't give them a penny.
Neither would I.
We don't know how long ago the alleged loan was made or how the heirs were made aware of the transaction. But, regardless, I doubt whether the money will ever get repaid. That being said, even absent a contractual relationship, ethics still come into play. Don't they ? If a Bank loans money to an individual and the individual dies, the debt does not necessarily go away unless there was life insurance on the loan.
The Probate court will ultimately make the determination if the Estate lists the person as a creditor.
