you know my aunt died about 3 wks ago, my oldest sis gets a letter from my cousin saying that are getting together at such and such a date to go over their mom's estate and they found that my mom had borrowed $5,000 from my aunt and they want to know when we'll be paying that back.

I was always told, "Never loan money to a relative if you expect it back". Absent a contract, one will never really know the "true" intent of the "lender" or "gifter".

Neither would I.

We don't know how long ago the alleged loan was made or how the heirs were made aware of the transaction. But, regardless, I doubt whether the money will ever get repaid. That being said, even absent a contractual relationship, ethics still come into play. Don't they ? If a Bank loans money to an individual and the individual dies, the debt does not necessarily go away unless there was life insurance on the loan.

The Probate court will ultimately make the determination if the Estate lists the person as a creditor.
