Nice shot, Kell. I saw that on a website this AM. ^_^

San Leandro, CA(Zone 9b)

Shoot, I spelled official wrong! LOL

You are too funny, Victor. But I embedded explosives in that photo. It will go PUFF without warning! Take it at your own peril.

Awhile back I found a web site where you can copyright your photos and tag them so you can track them all over the net. It is such a cool idea. And kind of fun! I have found my brug pics in France! I had small outrage but large WOW, kind a cool. Can you imagine where some end up?

Sadly, the cost was sky high to do it. I could do maybe 3. LOL

Dearborn Heights, MI(Zone 6a)

HI victorgardener and everyone,

Yes, the smaller images can be stolen to use on such as you said, Vender Websites, but they didn't pay for them!
I was just saying that the companies that pay $50 to $100 per image are not going to want a low resolution image.
Also when MasterTag buys an image, they ask for the high resolution image and it also states when I agree to sell an image that they can only use it for the original use and have to ask me to use it elsewhere.
Hopefully, they are honest.
I will just keep mine small and add a large watermark or large transparent text on the image.

Lower Hudson Valley, NY(Zone 6b)

True.

Baton Rouge area, LA(Zone 8b)

My pictures probably aren`t nice enough to sell for money but they are still mine and I don`t want people to take them to sell stuff online. This is about respect for others and not all about $$$

what happens (or happened) to all the photos that were submitted for the calendar?

Cochise, AZ(Zone 8b)

Look under Extras and scroll down to photo contests! Make sure you have a lot of time if you're gonna go thru them. Wonderful pictures and all in one place! Hope there will be a contest this year.

Encino, CA(Zone 9a)

Here's a useful site to see if any of your images are elsewhere on the net.

thank you, michael!

Northern California, United States(Zone 9a)

Nice except I have over 6.300 images on PF. LOL

Lower Hudson Valley, NY(Zone 6b)

It's probably a site that is actually stealing your pic while you think it's helping! Hee hee.

Wow, 6.3 images, Sue? I'm impressed. ^_^

San Leandro, CA(Zone 9b)

Get checking Miss Sue! LOL

Phoenix, AZ

That site is not very useful, Michael D. I don't see any of my searched images confirmed on the Web.

springfield area, MO(Zone 5b)

well wouldn't something you put in PF show up when you searched it ?

Phoenix, AZ

I searched about 10 images I've posted to several sites and got "0" returns. Dunno.

springfield area, MO(Zone 5b)

huh, weird.

Bark River, MI

Not related to DG, but I remember seeing in Consumer's Reports a while back that a family was visiting Japan on vacation and saw a large (can't remember if it was a billboard or what) picture of themselves being used to advertise something -- it was a photo they had used for their Christmas card and they had absolutely no idea how it ended up on a sign in another country.

Such is the reality of the internet, I'm afraid!

Sandy

(Zone 1)

Interesting. I just tried it and it says it searched 1.3059 billion images! And it only took a couple of seconds for my photo to show up. I'm assuming it's the photo I put in PF.

Actually, that's the image you uploaded for it to search, it says there were 0 results.

Cincinnati, OH(Zone 6b)

Thanks Michael.

A bit off topic but have you all checked the Terms of Use lately?
(If this was addressed earlier I apologize.)
It was modified on Feb 11.
Concerning Watchdog it says, as I read it, that IB will not voluntarily and can't be forced to remove reviews. Tough stand on Free Speech Issues.
I know Dave was constantly getting hammered w/ threats from companies who had received an unfavorable rating.
So it looks like the 'IB Legal Team' is plowing ahead and making Watchdog even stronger.

So things are changing legally... it takes time.
Ric

That is great news that they moved on changing that policy so fast So I expect them to change this one any second

to one that is fair to those of us who submit photos to PlantFiles especially since they have said they have fair ones already written that they could copy at their other websites that protect the rights of submitters to control use of their own photos.

Kalama, WA(Zone 8b)

Ric, Thank you for bringing that to our attention. This is really great news. Thank you IB. I feel that this is a good indicator that things may only get better. This is helping me to feel more positive towards it all. :-)

Yes, Kell, I hope that is fixed, and THAT exactly was the concern of my post.

Michael, thanks for posting that Tineye site. I found some pictures people had claimed were of their own work, but the images were taken from the originator's websites. Interesting stuff, very eye-opening sometimes! It's a great research tool.

And I'm very glad to read of the stronger stance with the Garden Watchdog. I left an unfavorable review of a car dealership on Merchantcircle.com and the dealer removed it that day. Left another...Removed again! A site is hardly a tool for consumers when the businesses can just remove the unfavorable reviews on a whim.

Hey everyone.

I just wanted to follow up on people's concerns here.

We have absolutely no intention to sell people's photos that they've placed on here - regardless of where they reside on the site.

We've never done it on any of our sites and I don't have any intention to start doing something like this now. In fact, as we run multiple sites that cater to photographers, I've learned a ton about copyright and artists' rights and have built those other sites to guard and protect these important issues. I expect to do the same here.

We will be changing the AUP, however it takes some time to run through our legal team, figure out all the nuances, submit it back here for comments and then get it up. And in the meantime we're working with all the contractors/writers on the site, learning the code, making some core back-end changes so that we can complete some architecture/server changes in the coming weeks, working with Terry and Melody to identify other improvements that can happen, etc. (at least all the things on the plate keep me out of trouble).

The Plant Files and all the photos within them is just a fantastic resource and a critical part of DG's success. We will not be doing anything to harm that.

Gosh, has so much time gone by (almost 2 months) when we were given these assurances in this thread yet Dave's Garden still "co-owns" all our photos we so generously posted in PlantFiles and elsewhere on this site? I thought Miguel said it was a quick fix to make it fair to those of us who post photos here so we soley own our own photos.

Miguel, I appreciate you saying DG will never sell our photos out from under us but it would be so much better if DG changed the written policy so you couldn't and future owners couldn't do anything they wanted with our photos. Why is it in writing in your policy if you have no intention of ever doing it?

This whole thing really makes me so sad.

Still ... waiting......

Northern California, United States(Zone 9a)

Still waiting too...Kell & I have pretty much stopped adding new PF images until this gets updated. We're getting backlogged.

Charleston, SC(Zone 9a)

On a related note, does anyone know if new PF images are even being processed? The last I heard new images were accumulating somewhere while PF Admins were no longer authorized to process them.

I, too, have been leery of adding additional images until things are 'ironed out' and we all know what the new rules are.

Not true. We did have a mini-backlog a couple weeks ago, because I was traveling and only able to hop on and off the computer. But the same people still have authority to release them ;o)

As to changing the AUP, I will defer to Michael to address that issue.

Encino, CA(Zone 9a)

Hey everyone. Thanks for the reminder. Things often move quite fast here and I got shuttled away on some other areas for the month of March.

I'm introducing TaliaRose here as well who Terry, Melody and I will work with (along with all of you) to suggest some changes to the AUP language.

We'll put something in front of you in a few days time and ask for your comments and advice. There will be some areas that we'll need to be firm on and others that we really want your creativity on. At the end of the day though, we want to make sure everything is absolutely clear so that both you and new DG members know what they're signing up for.

Lower Hudson Valley, NY(Zone 6b)

Cool.Thanks.

Crossville, TN

OHHHH I love making comments....and giving my OPINION. Bring 'er on! Jo

Hello Everyone!

For many of you this is our first time "meeting" - so hello! I am excited to meet each of you and to work together to resolve any concerns and frustrations you are feeling about the Acceptable Use Policy (AUP).

I want to thank everyone for making their voice heard about this particular issue. As we currently state in the AUP, "Our goal is to provide an educational and enjoyable experience for all our members."

To ensure that you feel well-informed and 100% comfortable with sharing your photography and other resources with the Dave's Garden community, we are currently reviewing our policies, specifically language regarding how we handle your photography.

We have your feedback in mind during this review process, and I will be in touch via this forum with some options by the end of this week.

In the meantime, feel free to send me mail, or reply to this thread if you have any questions, if you want to vent, or, if you would like to say "Hi" and introduce yourself.

THANKS for your patience. I am looking forward to resolving this together!

Lower Hudson Valley, NY(Zone 6b)

Hi TR. I look forward to resolving this important tissue. Thanks.

Victor

Charleston, SC(Zone 9a)

Terry,

Thanks for the info. I guess maybe I misunderstood something that was said earlier.

Cincinnati, OH(Zone 6b)

Thanks TR!

(Zone 1)

I don't have anything to comment about on the AUP, or regarding the use of our photography, I'm sure it will all be worked out in due time. I just wanted to say Hi and Welcome to TaliaRose!

Lin

Los Angeles, CA(Zone 10a)

Hello all! (-: Thanks for the warm welcome. I am still conducting my review of the policy. On a side note we are seeing beautiful sunny weather in Los Angeles, it's about 80 degrees!

Northern California, United States(Zone 9a)

Ahhh, don't torture them too much with the Calif. weather! :-)
It's not state wide by the way folks, DH & I just came home from a grand kid visit in No. Calif near (Mt. Shasta) at the 3500 ft elevation. We had a surprise late storm that dumped over a ft of snow.
I am glad to be home!

Murfreesboro, TN(Zone 7a)

It's 80 here too so no big deal. Tomorrow is another story - the predictions are somewhere between 59 and 72 for the high. I'm going with 72 - it sounds nicer ;o)
