i would like to know what kind of plant this is.
it's sort of a shrub growing right next to an oak tree.

It looks like one of the weedy nightshades (Solanum spp.) And ps- you'll get a much faster response next time if you post your mystery plants on the Plant ID forum. http://davesgarden.com/community/forums/f/plantid/all/
