how come I can not find the empress tree or the mimosa tree at lowes home depot or a local nursery.

Empress tree is considered a weed tree around here so no reputable nursery will carry it. You can order it from a catalog but I wouldn't. Although Mimosa is sort of a weed tree too, it is forgiven more frequently. Our nursery carries an improved variety called Ombrella from Monrovia Nursery. Just like I suggested with the tree peony, I'd suggest that you contact Monrovia to ask them if they've shipped one anywhere near your area. http://www.monrovianursery.com/contact/index.php
