Nursery license?
I do not know if you need a specific license to operate a nursery.
You may need to be periodically inspected by the NYS Dept of Agriculture. Be prepared to pay an inspection fee. Call them up on the phone. I have from time to time (on other issues), and they are quite helpful.
You definitly want to be incorporated (and insured). Be sure to file your quartery State (remitting sales tax collected), and Federal tax returns.
You want to be absolutely certain the land on which your nursery will be located is ZONED for this sort of business. In NYS there are DEGREES of commercial zoning. You want to be sure you can have outdoor displays!
As we have had year after year of drought restrictions on water use, you may need to aquire a water use permit exempting you in case seasonal restrictions are imposed again.
For those from outside NY State, this place is a maze of regulatory complication designed to collect fees at every step along the way from its citizens. This is a result of decade after decade of urban / rural conflicting interests.
From a distance, it's moderately entertaining. Living it brings other words to mind..., but Dave would remove my post ;~).
