Keeping everyone in prayers!

(Barb) Manchester, NH(Zone 5a)

Sending prayers for all for better days ahead.

Glad to know you may be home soon Karen.

And very happy to hear you finally have a date LK. I know Feb seems a long time to wait but it will go quickly with the holidays taking up a lot of your thoughts..

Must tell you all that I got a few of Cindy's candles and they are amazing. She does a great job.

Excited here as my son from Colorado is coming for a business trip and I will see him Monday night. Can't wait.

(Linda Kay) Amarill, TX(Zone 7a)

Oh. I have had Cindy's candles too. They are so nice.

Glad to hear you will see your son Barb. Enjoy his visit.

TORRINGTON, AB(Zone 3b)

Our Thanksgiving is done - looking forward to Christmas, in Our Own Home :-)

(Cindy) Auburn, CA(Zone 10a)

Aw Thanks Barb and LK

My candles are selling well!!! Just between some close friends and one family member I have made about $245!! That covers what I spent to make them. Tomorrow is the last day I am hoping the book shelf will be empty but that won't happen.

We will be having out Thanksgiving dinner at my daughter's. She does the turkey in one of those bag thingies, lol turns out very moist. I will be making Lemon Meringue pie and ?????? lol

(Linda Kay) Amarill, TX(Zone 7a)

Glad to hear your selling your candles Cindy.

(Cindy) Auburn, CA(Zone 10a)

Good RAINY Morning Friends,

It has been raining really good here since early this morning. Snow level is dropping to 3500 with the high elevations getting LOTS of snow now YAY!!!!!!

Thanks LK, I am anxious to find out just exactly how much I made. I don't think the boutique wiil do to good today with the rain, but oh well we need it.

Today is going to be one of those lazy stay in my PJ's day, lol

(Linda Kay) Amarill, TX(Zone 7a)

It is 10:320 and I am still in my jammies, cloudy, and drizzly here.

Bessemer, AL(Zone 8b)

sunny and cold here. got a pie in the oven, and a roast in the crock pot.

(Cindy) Auburn, CA(Zone 10a)

LOL it's 11:30 here and I am still in my PJ's been raining all morning with the wind blowing like crazy...I am not going out in this............

(Pegi) Norwalk, CA(Zone 10b)

It is 12:09 here and dark clouds coming our way, lot of wind too. Earlier it was nice and sunny so Mandy and I went over to the library to drop books in the bin. Decided to be extra lazy today and maybe just do some reading. Lots of Christmas stories on Hallmark Channel, but most of them I had seen before.

Thanksgiving will be at my brother's, just going to order a ready made turkey so no one has all that work. I'll bring my cranberry relish and green bean casserole. Now that I found the relish recipe I better not move it to a better place or will never find it..

Hope you sell all your candles Cindy. Hope Ernie is doing well, and glad Jaye is back with us.

Hi - shaking here
We have a hearing date on November 27th at 9am, and tonight our tenants served us with documents for a court hearing December 14th. They want us to stew on it for a month. We have until November 23rd (3 clear days before court date)

(Linda Kay) Amarill, TX(Zone 7a)

What did they serve you papers for?

TORRINGTON, AB(Zone 3b)

They want $1200.00 compensation for the hot tub not working;
$300 x two days for his loss of income to file the court documents,
$400 for painting the deck, laying flooring (porch - it had carpet on which he pulled out), and removal of our construction material.
$1k compensation for not being allowed "peaceful enjoyment of the rental" because we show up "in and around the area"
$75 filing fee
$3350.00 total (maybe I missed something?)

(Linda Kay) Amarill, TX(Zone 7a)

WOW! I wish you lots of luck in court!

(Cindy) Auburn, CA(Zone 10a)

Susan,
Was there anything in your rental agreement about getting permission to make any changes to the property before doing so? And did they know the hot tub was not in working condition when they moved in or was it?
And why would he need to take two days off from work to file papers? Sounds a bit extreme to me.

I hope you have a good attorney these people sound like con artist to me. They need to be investigated.

TORRINGTON, AB(Zone 3b)

lease said any damage to the hot tub was the financial responsibility of the tenant.
Can't afford $2500 retainer for lawyer..........
I'm on the phone (hold) with Residential Tenancy and trying to get the hearing changed to an earlier date so no more damage can be caused to our home

(Pegi) Norwalk, CA(Zone 10b)

I hope the judge laughs at the the stuff they want you to pay for. Most of the time here when I do watch People's Court the judge won't even consider "loss of enjoyment" of the property. I just hope all goes your way. People sue over the most stupid things.

Don't know what our temps were today, but the wind was bad. When we went to walk the dogs the cold wind blows right through you. I was looking for the cool weather, but never wanted bone chilling wind. Guess I will be wearing a warm jacket now. It is soup and hot tea weather now.

My niece in New York is doing fine with physical therapy. She was in so much pain at first, but is doing better. She is so anxious to go home to family. Hope this amputation is the only one she will ever need.

TORRINGTON, AB(Zone 3b)

they're talking about "loss of enjoyment" for us even being in the Park (in and around their home), and guess what? Our RV is parked in the compound, so we went there to get it ready on Aug 17th for camping, and returned it on Aug 21st when we returned from camping lol Kinda HAD to be there to get it from the compound and return it, right?

Susan here in the states, you are not compensated for filing papers and time loss from work. Because he could have done that after work...
Also "loss of enjoyment "is a weak term define loss of enjoyment ??? and can't be compensated unless physical injury had happened.
Honestly I don't think you need a lawyer. Did the hot tub work when they moved in?, did they sign the lease knowing the hot tub didn't work ?. Did the lease say all appliances and hot tub is to the managers and tenants knowledge in good standing and working condition?.
Looks to me the couple are grasping at straws.

TabacVille, NC(Zone 7a)

waving~`

TORRINGTON, AB(Zone 3b)

Sue - I believe the only compensation allowed for the filing is the actual filing fee of $75. It took me 1 hour at the office to file ours.
Within the lease it says "the hot tub is to be maintained as per instruction by the landlord. Failure to do so, causing damage to the hot tub, is the financial responsibility of the tenants."
We showed them how to take care of it and maintain it. If they've allowed the slow leak (which we told them about) to allow the water to go below a certain level, they may have "fried" the motor, which would be their financial responsibility. We also told them that running too many appliances at the same time will blow the breaker. They said they would likely never use the hot tub, but later said that Carolyn loved to use it. It's definitely NOT something that they can claim that they were promised and therefore the reason they rented - neither Health & Safety nor Residential Tenancy will say it's an essential part of the rental. It was a "nicety" but not a necessity..........

(Pegi) Norwalk, CA(Zone 10b)

Today it is back into the 80's. We had a taste of winter for one day.

My neighbor left without even saying good-bye. Men came last night and put a tent over the house for fumigation, so guess the property did sell. Don't know how I missed them moving all the furniture out of the house. Just hope we get decent people moving in.

Praying for all.

TORRINGTON, AB(Zone 3b)

how..........interesting...... that your neighbours didn't even show the courtesy of saying Goodbye. Did they move at night?

(Linda Kay) Amarill, TX(Zone 7a)

Hey Jaye. I hope your doing OK?

Pegi, that is odd they moved so quickly and not saying anything.

TORRINGTON, AB(Zone 3b)

hooray, hooray, hooray!!
We just got an email from our Property Manager at the Mobile Park, with a statement that we needed to back us up for our Eviction Notice of our tenants (they were to be out on Nov 15th).
It says exactly what we need - that the tenants called them to remove stuff from the backyard, and the tenants told the PM about the gas leak and he called us, but that the TENANTS had not made us aware of it. hooray, hooray - it's great!! THIS is one of the reasons they were to be OUT. They broke a substantial tenancy act agreement!!!!! I'm SO pleased.

(Linda Kay) Amarill, TX(Zone 7a)

That is great news.

TORRINGTON, AB(Zone 3b)

We'll get a neighbour to see that we served the documents (invoice & statement from the City Property Mgr) on their property. They do try to evade us, but they can't, with a witness.

btw - when Health & Safety came out on Tues the 17th, they told him that they are going to court with us, on the 27th, so obviously they've received the documents.

That is good news Susan

(Pegi) Norwalk, CA(Zone 10b)

Another balmy day, still looking for rain.

Susan, seems the tenants are digging themselves into a bigger hole. Waiting to hear the good outcome and you will be back where you belong soon.

It is so odd about my neighbors, I saw her outside one day and asked if she was selling the house and she gave me this big story about her health, blah blah blah. Price on the house $429,900 and sale is still pending. I keep looking on the realtor's web site for more information. Since the house was tented and fumigated it seems to be the house may be in escrow. They did move out in the middle of the day, I can't imagine how I missed seeing the truck. I lived next to her for 15 years too. I only hope new owners are decent people. She said she is moving in with her daughter who lives in Northern California, but I'm sure she is staying with her son for now. A lot of houses up for sale throughout our neighborhood. Must be a good time to sell. What all I learn while working the dog. LOL

(Barb) Manchester, NH(Zone 5a)

Keeping you and Bob in my prayers Susan that things will go as hoped. I won't say planned because we all know what happens then!!!!!

TORRINGTON, AB(Zone 3b)

I'm counting the sleeps until Friday....... have to make a list of things to say, in the order I need to say them, and so I don't forget anything important.
When Residential Tenancy tells me that the 3 reasons I gave for 2 week notice (Nov 15th), are correct, and then we go to a hearing with a Residential Tenancy Officer presiding over the hearing.... well, it seems rather black & white. Especially with the Property Manager giving me a statement in email (and his ph# to call if there are any questions) which says 2 of the same things, I can't see how they CAN'T get evicted. It's only WHEN........
