i will try and get a pic if it blooms but husband threatens to pull it and neighbor says its spinach , but she says a lot in my yard is spinach and i don't really care for it so i can't see why i would have it ha! Neighbor says she gave it to me. I just don't remember this.

you might try posting your pics on the Plant ID forum--not sure if all the ID experts watch this forum but they will definitely see it there and may be able to ID it even without flowers. http://davesgarden.com/community/forums/f/plantid/all/ (It's not spinach though...and I doubt any of the other stuff in your yard is either if it's things that popped up on their own vs something you planted on purpose)

There are woody looking stalks in your picture...and even though the leaves do not look quite right, it rather reminds me of Cestrum nocturnum, or something in the jasmine family.
