Looks like lantana to me.

Yes, Lantana camara. It's a perennial but won't be hardy in your zone, so if you want to keep it for next year you'll have to bring it inside for the winter.

So this is a shrub ... anyone know how big it will get?? I can't find a clear answer

They can get ~4 ft, but since you'll have to keep yours in a pot to bring it in for the winter it'll probably stay smaller than that. And you can keep it trimmed smaller as well if you don't want it that big.

will it not survive the winter here at all or will it just keep it small?? If this is a shrub i would love to put this out front but if it will not survive our winter then i'll just keep it potted.

It will die in winter if left outdoors in your zone (and mine).

If it gets cold enough, they won't even survive the winter here. If you want to keep it potted, then I'd do as ecrane suggested and prune it back so you can control the size. The other option is to do what I do--they are inexpensive and easy to grow so I just start with a new one each spring. I do love them and so do the butterflies.

what are the balled up hard things on it....seeds??

Dublin, CA(Zone 9a)

I don't see any in your pictures, but the seeds look like little berries. They start off green and will turn dark purple over time. Here's a picture of what they look like: http://davesgarden.com/guides/pf/showimage/211674/
