Thanks everyone - that really brightens my day - and I could use it. Just found out the Dept. of Labor has rejected our application - so now we might be deported next Aug. sigh.

You have a job, a family and a house. Do they say why your application was rejected? Is there any appeal?
Yes - there is an appeal. I have until Sept. 20 to appeal. If the Dept of Labor does not approve my employment as a permanent employee I cannot apply for permanent residency and will have to leave the country next summer.
I think it was rejected because it didn't have a lawyer's name attached :-) I didn't think it would be difficult for a Canadian to get permanent residency (little did I know). Actually, there is another way around all this, I can work under the NAFTA agreement (assuming no one changes the rules) but I would have to pay taxes in the US and Canada (since I would be required to have an address in Canada) - and I would have to return to Canada and re-enter the US every year.
That's not a great deal. Can't see why you would not win your case. How long are you at your school? Since '04?
Doesn't sound like paying double taxes is any answer at all. How annoying!
You'll never guess what I am doing to de-stress . . . I am sitting in my office husking daylily seed pods I collected this morning. By the time I am finished I will probably have over 500 seeds! But, man, are there a lot of earwigs hiding in the pods. Into the garbage they go - and I am hoping their preference for dark keeps them hidden in the plastic bag that lines the wastepaper basket (and which is filling with empty pods). when I am finished I will tie the bag with a knot and drop it in the dumpster. :-)
Send them to INS if you lose your case.

Well, my issue isn't with the INS - yet. I would love to have an opportunity to talk to them - but it's a no-go without the approval of the Dept. of Labor (an approval I have been waiting for since June 24, 2004 - only to be refused!)
Oh, well - things could be worse.

The department of labour is only trying to protect American jobs from foreigners working below the going rate. They don't care whether I am good for the country or not . . . on the other hand the INS might - if I ever get a chance to talk to them. I see the lawyer tomorrow afternoon . . .
I seriously doubt your view of the Labor Dept., given how many people are here illegally earning 'below the going rate'.
Yeah - but I am here legally - that's why I have problems lol
