i have sent several emails asking for a valid shipping date tracking number. after all this time the other day i emailed them if something wasnt sent one way or another seeds or refund i would go to ebay and report them and leave bad feedback.
now the question i have is they threatened if i left bad feedback over this (due to not recieving the items) they would see to it that i was banned from ebay.
i have since sent ebay an email about this problem and the threat of leaving bad feedback.
is it possible for sellers to get someone banned for leaving bad feedback?? i dont know where to turn and really need some advice as i know alot of us at one time or another sells on ebay.

Ebay will not ban you for leaving negative feedback as long as it is not slanderous or unseemly name calling. However, a person can be reported for threatening to leave negative feedback via email. That is called feedback extortion. It usually applies to demands other than simply receiving the product purchased and paid for. A member can also be reported for spamming or harrassment if using ebay's email system. Just be careful that you are not asking for something that wasn't part of the transaction (i.e. the seller is not required to give you a tracking number), and that you do not email him so often or use verbiage that could be considered spamming or harrassment. How long has it been since the seller received your payment?
we have been emailing back and forth almost everday until last week. then no emails for a week due to the fact she said her college roomate took her lap top to chicago with her.
i broke my ribs . i told her in an email that i had been in the hospital and that i havent gotten any seeds as of yet when i got out the hospital a day later. she asked me if i was comfotable and we both joked about there was no comfortable postion to be in with broke ribs.
then we joked about that i was (worried) about not getting the seeds. which in truth i am a worry wort by nature . I still havent gotten the seeds yet.
her feedback is 10 as she is new. i paid by money order.
then when i didnt get the seeds like promised one more time which the last ship date i got was last monday and still no seeds as of today.
she sent a tracking number but the usps.com site has no record of it and she said it was sent thursday of last week. wouldnt the trascking number be in the system by now? i think it would be.
they recieved payment for first item on the 18th of oct was told shipped the next day and for the rest the 28th of oct was told shipped the 30th.
i can understand the later items getting shipped later then the first but i havent gotten any of them.
i have told them i was gonna leave bad feedback due to not recieving any items yet and was gonna go to ebay about this .
because i have several emails saying shipping dates and i should have it withing two days and nothing is here yet.
shoot i have faimly over in arizona and their mail has been here in three days. and thats regular mail so i dont know why its taking 3 weeks since the first ship date to get here.
i guess i am just out and theres nothing i can do about it. but i dont care to be threatened due to the possibility of me leaving bad feedback.

i would let e bay know ..if sent would be tracking nu.. i would tell them something to let them know your not afraid them, you want your seeds not a run around..
USPS is notorius for not scanning delivery confirmations. Also delivery confirmation is not the same as tracking. The only benefit to it (assuming that the delivering mail handler scans it) is that it lets the sender know when it has been delivered.
And I think I mentioned this in your previous thread. USPS hired a independent contractor a few months ago to do postal inspections. Since then more packages have been opened and confiscated for either using inappropriate mailing rates (e.g. media mail to send bowling balls, or using priority packaging turned inside out for non priority shipping) or for illegally shipped items. The latter could come into play here if the seller does not have a USDA or state certification for mailing seeds.
You might try going to your local post office and filling out a trace request. You will need the senders name and address, the date sent, and the delivery confirmation number the sender provided. However, it is not likely they will put a trace on it this soon after it was shipped. Last Thursday was only 3 business days ago. USPS does not guarantee any delivery time frames other than overnight express mail.
I'm afraid eBay cannot provide you with any recourse on this transaction other than your opportunity to leave negative feedback. Other than acting as the advertising host, they are not a party to the transaction and can not force the seller to provide a refund. You can take it to Square Trade which is an independent arbitraitor available through Ebay, but there is a fee ($25 I think) and both parties (i.e. you and the seller have to agree to arbitration).
in my letter to ebay, i would include the letters sent back and forth, in an attachment. you might want to put the letter that threatens you in the body of the letter.
give them several days to respond, before writing to them again asking for a response.
be very careful what you write in an e-mail to her. as others said, language is very important here.
i'm sorry for your problems.
i also write another letter to the person, asking to restart this conversation and to let her know you just want your merchandice, that you don't want to leave negative feedback etc. sometimes, honey works better.

You could be banned for joking of bodily harm and I am not sure if she could do anything legally if she took it as a threat. Did you tell her it was a joke? Not really but could say she did.
How did you pay for this? paypal?
What is her feedback? How many feedback does she have?

no bodily harm was ever mentioned in anything.
I reread your edited post imazadi and it did clarify some things but confused others. Originally you had said it was shipped last Thursday and now it says Monday. I understand that the seller has provided multiple shipping dates but I am having trouble following your sequence of events. If you would like, post or email me the item numbers of these transactions and the tracking number you have and I will see if there is anything I can do or suggest to straighten this out for you. Some times when the lines of communication between a buyer and seller have gotten blurred or there is friction between them, it snowballs into something that no longer seems like a simple business transaction and having an objective 3rd party look at it might help.

i got a tracking number monday(Nov 8) morning. the latest one now. no note no nothing just a tracking number. well this one says no record of it ever being entered either.
its like i get a new shipping date or new tracking number every week and none of them are valid at all.
Money recieved on oct 18th
first shipping date oct 19th first package tracking invalid
money recieved for other auctions oct 28th
second ship date oct 30th no tracking number
since then i have had ship dates of:
25 th no tracking number
27th no tracking number
29th tracking number invalid
4th no record of tracking number
this is madness. i sent it all to a mediatior sunday evening( as i am scared to email them anymore) and then i got the new tracking number monday and its not on record.
this is madness and its seems to me as of today i aint getting these and there s nothing i can do about it. its under 30 dollars and ebay doesnt cover that in insurance and i am stuck.

Wow Imzadi, I am so sorry that happened to you on E-bay. I know you have had that same type of thing happen to you several times here on DG and it must be really frustating to have the same thing keep happening to you over and over! I guess the best thing is to try and use your best judgement .

Where are these tracking numbers coming from, the seller or the USPS? USPS has an option where a person can print a shipping label and select delivery confirmation as an option and it will generate an automated email to whatever email address is provided with the delivery confirmation number in it. That is done before the item is taken to PO to actually ship and if it isn't shipped or scanned or the sender then applies a different or no delivery confirmation sticker to the package, the first one is never entered into the system. I still have the sense that this may be a simple miscommunication or misunderstanding that has been blown out of proportion on both ends. I hope mediation will help you resolve it and I assume you know that process will involve continued communication between you and the seller.
The eBay standard purchase protection program provides partial reimbursement for losses resulting from non-delivery or misrepresentation of most items up to $200 (minus $25 processing cost). So your transaction should be covered but with the processing fee, the amount recovered would be insignificant. If you have not already read it, this information might be useful to you:

Ncgarden addict i did have the problems with the old post office i lived at yes. those are over now. shoot i get things fast at this new one. i am gonna take it with me if i ever move agian.hehee this i think has nothing to do with the post office though. i think this has to do with the seller. i havent missed a thing since we have moved. yes mail is slow and around the holidays its slower but this has been going on for three weeks now and different dates and tracking numbers and everything makes me really suspisious.
the tracking numbers are coming from the seller. i talked to the mediator and told them i was not gonna email them and he said thats fine as long as i talk to him and send the emails i want to send through him.
he is looking into the tracking number as i stated its not on record and doesntlook like its gonna be a good one or if at all valid.
i think this will be the best way to handle this and that way no ones feelings get hurt or threatened agian. hopefully it will work out.
