Need Some Advice

(Zone 5a)

Someone wants to use my photos as an advertisement to sell seeds and plants from their nursery. I would like to know if anyone here has been through this? I would also like to know if there is some type of pricing guide, and I need an idea of what type of agreement to draw up.

Hey Kit, that's awesome. I remember someone asked this same question one time, but don't remember who it was. You might email Terry, she might know or have some info for you. Good luck. Hope you make some money on the deal.

Ask the person who is wanting them if they are willing to pay. He/she may only be asking for permission, not making an offer to buy. There are several different ways that is typically handled. You can either give him complete rights to the photos meaning he has permission to use them in any way and for as long as he wants to. This can be done by either selling him the actual copyright (he which case he now owns the images and you can't continue to use them without his permission), or you give him unlimited and perpetual use of the images but you still retain the copyright. Or you could give him limited permission restricting use of the images for a stated purpose and/or for a stated period of time. Don't be surprised however, it the extent of what he offers or is willing to pay is to trade for a couple of plants from his nursery. Remember he is probably looking at adding some verbiage to the images and either making them into a poster or to put on some sort of flyer which is still going to cost him to have the images worked and printed. Often times the only offer made is to give credit to the photographer in the form or fine print or a watermark on the image itself (ala DG).

Thanks Socal.

Pville the person did offer to pay for the use of my photos. I won't sell the copyright but will let the person use them but I have to decide for how long and how much to charge.
Most of my photos that I have given permission to be use were for charity, so I need to find some information on how to do this so that it's fare to me as well as the person that wants to use them.
Do you know if there is any kind of book of this subject?

No book that I know of. This isn't really a tangible product that you can put a commodity price on. What he/she is willing to pay and what you are willing to accept is what is fair. Most stock photos (image files sold retail for unlimited personal or commercial use) sell for somewhere between about $40-200 for a full CD of photos. You might do a google search for stock photography or stock photo cd.
