CAN ANYONE ANSWER THIS?

IF A COURT PUTS A LIEN ON YOUR HOME FOR UNPAID FINES
WHAT WILL HAPPEN? CAN THEY TAKE THE PROPERTY?

Denver, CO(Zone 6a)

I do believe they can sell your property to recoup the unpaid fines but usually it is a last resort. Even if you can't make their payments, try paying a even a little portion - say $20.00 a month. It shows that you are willing to work with them. Another thing to do is contact a non-profit credit counseling service. They can often act as a go between and make deals with your creditors to lower your monthly payments with no or low interest. They might be able to help mediate with the county.

In most states, they can put a lien on your property but they cannot force a sale on the roof over your head. They do not want to make people homeless. They may sell other real estate, cars or boats, etc., to pay a debt, though
However, this is not true of the IRS. They can take your home.

I thought that when a lien was put on someone's property that they had until they decided to sell their home to pay off the debt. If it is not paid off at this time that they would collect the amount of the debt when the sale was made. These things may vary from state to state. Do you have a lawyer that helped you through this, maybe they can answer your question.

Well, that's right Deb. If the lien is on your principal domicile, it can only be paid off if the property is sold, usually taken out to settle the lien at closing. Trouble is, it may be accruing interest and be much higher than the original indebtedness. But a forced sale, sometimes called a "Sheriff's Sale" can be inacted on other property that you may own or on a car or boat or any other valuable item that is like to cover the cost of the debt at the Sheriff's Sale, which is often held on the courthouse steps as an auction.
Again, none of the protection for your domicile applies if it is a tax lien. They can sell your home for back taxes although usually it takes years before they resort to that.
