Needless to say, most of the few remaining survivors also subsequently died. Although I have deleted a number of TN Nurseries advertising emails over the past few months, I have many backed up in Outlook Express. I found one where TN Nursery is offering me $10 in credit, or free advertising on their site to post a positive comment. I will not speculate why they increased their offer from $5.00 to $10.00 for a positive rating. Susan Green's email also confirms that TN Nursery and Tennessee Wholesale Nursery are the same company. Cross checked posts on the web and Daves Garden forum; including response postings by TN Nursery staff indicate they also have DBAs under DNT Nursery, D & T Nursery, Quick-Growing-Trees.com, Fast Growing Trees, and Wholesale Native Plants. My credit card and emails to the company indicate they are also doing business as Tammy Sons, Tammy & Sons Logging, and Tammys Pools. Under the circumstances it would be very difficult do a search with the State of Tennessee to determine which of these numerous DBAs are valid businesses, and which are website businesses or aliases with no physical address; bringing in sales to Tennessee Wholesale. ( Note that 'Nursery' is now omitted from the business name), which the company stated on 7/22/11 is is their true legal name. Fortunately, I've saved most the dead plants and can take pictures to show what I received. I can also take pictures of the 6 struggling blackberry survivors along with actual boysenberry plants in my 2 patches. As the saying goes, "A picture is worth a thousand words" and a comparison is easy to do. The leaf color and count are different, as are the vines and thorns. Looking at TN Nurseries website today, it has changed substantially since I last visited it and I have copies of their original terms and website policies from my chargeback. At this time they have posted a BBB blue logo on their website from the Better Business Bureau, although they are not a member and have no affiliation or accreditation. I was even more shocked to read this in their current posted terms: Q:What If I Order and Then Try To Get A Chargback? A: Call us. We report all chargebacks to collections and after 30 days. we report to the 3 major credit bureaus as deliquent.This severly lowers your credit score as well as cripples your ability to get a loan,line of credit or a major credit card. Why would they need or want to threaten their customers in advance, and POST it on THEIR public website? If a company sends the right plants, the correct number ordered, and they're healthy, customers would not complain. Moreover, it is illegal for a company to turn over an account to collections when there is a valid dispute in process. Under the Federal Fair Debt Collection Practices Act the collection agent and the company can then be sued for monetary damages by the customer. Customers also have the right to send a letter to the collection agency stating the reason for their chargeback, and that the collection agency is to have no further contact with them. It is called a 'cease comm' letter, and at that point the agency must return the account back to the alleged original creditor. Then the consumer can send their evidence and correspondence to the 3 Bureaus and ask that they remove the derogatory entries wrongfully placed on their credit reports. Sadly, 99%+ of consumers don't know their rights and are victimized by numerous companies every day, especially hospitals and credit cards. Companies just love it when a consumer tries to get a loan and has to pay money they don't owe to clear up their report immediately because they have no time at that point to legitimately dispute false derrogatories. It is estimated that more than half of all credit reports and negatives are false. A consumers best advice is to check their report yearly and dispute all misinformation so they avoid these problems or nip them in the bud. Obviously, phone and email communication normally resolves problems before they get out of hand. And as I've previously posted, sending the right plants, accurately counting them, and making sure they are healthy before shipment is a lot easier to do than arguing with a customer and citing no returns or refunds after the fact. My own situation mirrors virtually every other complaint on this site. Out of dozens of phone calls and emails I made and sent over a 2 month period following the receipt of my order, only 1 phone call went to the answering machine. In every other case I was told by the machine that it was full and could not accept messages. No emails were ever answered. It was only after filing the chargeback that 1 phone call was answered by a defiant woman who threatened to ruin my credit and that it was company policy to thouroughly deny all chargebacks, and that once a chargeback was filed that a customer would never get their order replaced and would be blocked from buying on their site entirely. However, when I called on different phone lines they were answered promptly and courteously by both the sales department and customer service, ready to take my order, or give advice on blueberries which I also inquired about. Caller ID, call screening, and call blocking are edged swords, but they should never be used to prevent customers from calling customer service after an order has arrived, and ultimately seeking what they actually ordered and paid for. The friendly folks at Dave's Garden determined these positive reviews to be bogus and downgraded them to neutral. This deceptive practice by Tn Wholesale Nursery which, by the way, has been tried in the past, is just one more indication of the lengths Tn Wholesale Nursery will pursue in an attempt to cover up their true nature. On October 18th, 2011, Scammed added the following: In response to my negative review on Dave’s Garden I was sued by Tammy and Dennis Sons (doing business as Tennessee Wholesale Tree Nursery) for defamation and for damages in the amount of $13,000 plus court costs and attorney fees and the demand that I remove my negative review from this website. The 4-hour trial took place on September 27th, 2011 in General Sessions Court in Grundy County Tennessee. Both Plaintiff and Defendant were represented by counsel. After deliberating for over a week, the judge delivered the following verdict. The case against me was dismissed for lack of jurisdiction in Tennessee and because plaintiffs failed to establish a prima facie case of defamation. The very next day, October 8, 2011 I received this e-mail from Dennis Sons: "Due to the verdict,if we can not work out a refund and request a written email removal to admin@davesgarden.com of the comments on Daves Garden,we will escalate this to the General Sessions Court.If this doesn't work in our favor,we will hire an attorney in your county.This is our income like your job was your income before your retirement. I'd like to work with you one on one.Attorney's fees are expensive for both of us.We will mail you a money order for the refund if you will give us a written statement that you will remove these comments from Davesgarden.com upon verification and receival of the refund.You can have it notarized. The sad thing was Tammy said you seemed like an honest man.This makes no sense to fight this out when we are willing and you should be also to end this." I DID NOT RESPOND TO THIS THREAT! The deadline for Tennessee Wholesale Nursery to appeal this decision. i.e., escalate to a higher court, was October 17, 2011. No such appeal was filed. So, after I made the long trip from Maryland to Tennessee and spent thousands of dollars defending myself from this lawsuit, the nursery offered me a refund of what I assume to be the $220.30 to cover the cost of my initial purchase and then threatened me yet again with further lawsuits if I did not accept their terms and remove my post. ’Nuf said.
