I've sent them a demand to remove it; I gave them until Jan. 3 to comply (in fairness, I have to give 'em a little time to read and respond since today is a holiday.)

arejay, I sympathize with your idea, but I can't recommend "vigilante justice" activisim.
For one thing, it's impractical: eBay's feedback requires that you have a transaction with that vendor in order to rate them, and for good reason.
Speaking as an administrator who occasionally finds that type of "piling on" in the Garden Watchdog, I can tell you that activity punishes the administrator of the feedback tool far more than it does the person whose reputation you're trying to smear. The administrator is the one who has to clean up the mess, while the vendor is squawking, and the vigilante crowd gets hostile because their efforts are being thwarted.

Is that actual picture of the Brug or would I be getting a different one then is actually shown? Is a simple question to ask he will get the idea and his reputation will follow him.Just go to the ask the seller a question. There is power in numbers.

Have to agree with Terry. X and sevral of the others on here are professional Brug growers and breeders and they have the respect of the Brug community around the world. Pics and articles need to be handled in a professional manner.
Good they let us know what goign on, so folks can be aware of the these seller practices, and not to buy from them, but it still needs to be handled professionally.
It not a good idea to try be a vigilante even though know your heart is in the right place.
X.. would still keep an eye out. Have seen the sellers pull the ads, only to wait a couple weeks and try and sneak them back in tryign to recrop again. Last one I saw do that after be warned from ebay, when the photo owner complained yet again when the same pics came up that seller was removed from Ebay.

Unbelievable!!! Theft is theft and this is just not right on so many levels. As for being on their camera - doesn't take a rocket scientist to take a photo of a photo...as others have said though with the copyright in the upper left hand corner and (?) your hand in the pic seems a no brainer. Sad that it comes to this - I mean seriously...take your own photos (directed at ebay sellers etc). It's very reassuring to know DG has everyone's back w/regard to photos and copyrights.
Just realized in reviewing their listings that most of their photos won't open, when clicked on, to a "full" size photo...another tell tale sign of being copies from another source.

Speaking of having your photos used elsewhere.... I just now was searching on google for info on a brug and came upon 2 of my pictures posted on Flickr under a member from Dave's Garden that I know from the brug forum!!! I am so shocked. Isn't Flickr a place to post your own photos that you took?
I just joined Flickr so I could ask him why he has 2 of my photos on his page. I generally let people use my photos though not for money making purposes like on eBay. But when used I at least want credit.
OMG, Kell...see THATS worse (guess we kinda hold each other here on DG to a higher standard)...making me want to start searching for photos.
with the way the economy is going, i have a feeling there will be lots more. it's just easy money for unscrupulous sellers to take someone's picture of a desirable plant and sell their noids at a premium price.
i have no answers.
The answer is DON'T BUY from these people and spread the word for others not to buy from them. Hopefully that will send a strong message to these untrustworthy sellers that fraud will not be tolerated.
well they finally removed my pic. They said they were yesterday but never did. So this morning I sent them this message and the pic is gone
my picture still has not been removed from what I see on your auction page. e-Bay will remove your auctions and put you on a watch list for future auctions when they investigate my copywrite infringement claim against you if the picture is still there and any of the others that have filed claim against you. It's your choice

Mary, I contacted and received an answer from the owner of that photograph. She confirmed it was her photo and that she had not given the e-bay vendor permission to use it, but she didn't specify what she planned to do about it.
I have not received any reply to my question to the vendor.

strangely enough, I'm not surprised that people do this, which is sad. But, it's amazing to me how blatant and bold they are about it.
I was just browsing the brugs on ebay and recognized my photo immediately.
pic now different on eBay, it would seem?

As closely cropped as the new picture they're using is, it wouldn't be a surprise if that one was 'borrowed' also.
