Every year I container plant herbs -- usually from seed but this year from a garden center. Basil, thyme, mint etc. I'm in central Minnesota where we have had a very late Spring and a very wet one so many this is the cause but I have flies (just regular looking flies) that will NOT leave my herbs alone. I've never recall having this problem before. They don't appear to be eating them (yet) so what are they doing? Laying eggs, I fear, or what? And because they are herbs I don't want to spray them with an insecticide. Any info and advice is much appreciated.

Some herbs attract flies as polinators. If you don't see maggots in the gound they are probably polinating your plants. I have the same thing with mine.
