Deed restrictions are the worst. Recently attended a city meeting - about sidewalks - but much discussion about where trees could be planted. One subdivision has (in the deed resrictions) that trees MUST be planted in the "green" strip between the sidewalk and the street. Right where both are bound to be torn up as the trees grow. Learned that while the City has an ordinance specifying a 3 foot setback for trees from any sidewalk, driveway or street - it does NOT have jurisdiction to override the deed restriction - has to go back to Austin and the legislature - it is a land covenant. Arrrggghhhh!!!

Another deed story.
A friend of mine owns a house that borders a major street. Between the major street and his garage is a public alley way. Of course, between the alley and major 3 lane street there is a brick wall. The alley and brick wall are not part of his land or square footage. However, someone lost control of his or her car while driving on the major street and crashed into the brick wall. Guess who is responsible for fixing the wall. The HOA, nope. The city, nah. It is the responsibility of the homeowner who's house is closest to the brick wall. Crazy!

I am already a member over there Sylvia, they can do nothing sad things too... I will be keeping my membership there thought, very good group.
Ok I got it down to mostly what they wanted... I have the biggest and oldest beds still in one piece and parts of the ret still out there. I did not move very much at all just placed a brick here and there where in the Fall I will need to move things a little and I have space. What I am going to do is get a row of trees to go around the edge of the property and then a row or two of shrubs next so I can do what I want with the space in the middle and who is going to see?
Good for you MItch! I know you dont like Poplars, but they grow fast and is cheap. You can plant trees that you love next to them and cut the Poplars down your real trees get going.
Darn Mitch you might have to grow Hostas, sound like you gonna have a lot of shade back there. lol

I absolutely hate/dispise/can't stand home owners assoc's. My mom lives in one and she can only have a garage sale 1 time a year when the entire neighborhood has one. UGH I have heard of them only allowing 3 types of trees in your yard. I don't live in one thankfully but it will be difficult if I buy another house somewhere. What gets me is, they don't pay any on the mortgage so why should they have any say in what you plant on YOUR property? Sorry, it just bugs me.
Who knows, they may be the problem with part of the housing slump too! People hate to be told what they can and can't do when they own the property. Before they seemed the way to go, but after the "uglyness" started showing it's head, nobody wants to go there anymore. I know I would never purchase a house with them overseeing it!
Same here... but I did not know their rules can stay with the land forever. I will only buy rural or older city from now on.
