to compare. Its a color slide and I made it in my garden.
The copyright has been removed. I know, that I posted this picture in a thread here in davesgarden and mentioned the parents. They colored the flower, made it real red, even though, it is a deep Pink.
Charleston x L'Amour picture
How sneaky! We should all email them and ask why they would take off someone's copyright and publish their picture on their site without asking. As they want to sell their plants, I think they will be unhappy to know they have made Davers unhappy with their practices.
their email:
asap@toptropicals.com
Esp since on their site they have this

Grrrrr!

Why don't we start a letter here and CCP it in a e-mail to them. If everyone of us e-mail them after getting a few they probably won't look at any more and just delete them. Someone write the letter and include everyones name that wishes to be included and let them know we have added them to the garden watchdog list here.
oh man, I hope you wrote them monika!!!
I would think a box full of emails would be quite persuasive!
Also I think I read from a post from Terry that Dave's would intercede over picture's being stolen.
I just think it is rotten that someone would steal a pic to help profit themselves! Totally rotten!
Monika the bloom is beautiful! Go get em girl....LOL
You're right Monika. Here's the thread. I would let Dave know about this. http://davesgarden.com/t/188537/
So sad to have crooks everywhere! Your brug has a beautiful bloom Monika.
Monika, Just noticed something strange.
It's the same picture but it looks like it has been turned around. The upper flower is on the left side and also the flower in the background.Same flowers but look the opposite of your picture. Very strange.
Have you noticed the message THEY added about copying pictures???
"None of the images should be used without permission."
That sure is the same photo reversed. Thoses creeps!
Monica, you say the word and we'll get 'em. Whatever gives you satisfaction... However, what's the price for stealing a copywrited photo? Make them pay or they'll do it again ):
Thank you snow! I was searching for this thread!
Is this the one on that auction site? (dont know if I should mention names)
Dravencat, you should contact Dave about it if you have seen this picture at an auction.
Monica, I just found what you were talking about, I thought it was an auction and that is definatly your pic. It is no coincidence Ill write em to if ya want. And did you send a message to Dave yet?
It is too bad that someone has to copy a picture to make money for themselves. I also think Dave should know about this one.

good idea shelly. they'll just take them off, but I bet they get the message.
Wow, did you just happen to come across that? Where have I heard of Top Tropicals b4? The nerve! One of those people is a member here?
Thank you all. Dave knows already about it.
that page is an advertisement page look on the bottom and it takes you to their main page with pics too.
Did you all have to register to reply?
I did
Thanks. If they have taken the picture down, I guess you guys got your point across.
You know... for registering... you can put in anything... doesnt have to be YOUR email address... I actually put @davesgarden.com
lol so... :o)
They removed the pic! And a few others.
Yes i noticed that to I had to register also to post my message i feel sure after they read it I will be booted off there of course i never intend to go tehre again, The sneeky petes.... There is a picture on teh posting page of two people i think teh owners they sure look familiar any one see that?
Ah, the awesome power of Dave (and his Garden Watchdog). lol
I thought I was nuts,I kept looking all over for the picture, good they got it off!
Perhaps they didn't know what they did was wrong. I'd like to think so anyways. At least they didn't waste any time taking the picture down.
they took time to reverse the picture, seems they must have known.
And removed the copywrite.
In justice to the folks at Toptropicals, they explained to me that they never downloaded or manipulated the image personally themselves at all. They told me that it was given to them several years ago by another party. As soon as they learned of the copyright infringement, they took it down.

I'm afraid they did not tell you the truth. If you look above to the hyperlink I posted you will see that it wasn't even in existance several years ago.
The picture was posted here on DG on Feb.9th 2002.Monika states on the thread it was a seedling.
Good for them, and Congrats Monica and thank you Dave.
Ok I went there thru a hyperlink in another post in Brugs, its still there, I refreshed it its still there. Should I type it in myself and look or should it not be there at all
Now it figures I just went back not a minute later and now its gone.

Oh, I am so sorry. I did want to give them the benefit of the doubt. Thanks for setting the record straight. I even apologized to them for accusing them of what I termed "contemptible behavior." It's just too easy to steal people's images. And nothing can stop it if one's basic integrity is lacking. Watermarks, javascript, even fines and lawsuits do not not seem to deter determined thieves.

UPDATE: I just re-read Mike's letter and this is what it says "We didn't take that picture from Davesgarden website and we didn't edit/remove copyright information. Somebody sent it to us long time ago. I apologized to the copyright owner and immediately removed the image. I'll personally check all other images to make sure we own copyright or have permission to publish it.
Thanks,
Mike
He does not say several years. That was my error. I do not think there is more he can do. Let's please be fair to him if it was indeed an innocent mistake.

It is not the worse thing that has happened. They were making no claims about it and they were not selling any brugs with it, they just had it on a picture page. I have seen a guy on ebay selling a brug with a fancy pic of a euro brug that was not even released yet in Europe. For him I have contempt. I do not believe these people deserve to be tar and feathered over it.
I am glad to hear they responded so quickly and appropriately.
I have got to say that picture is a beauty, Monika! I understand someone wanting to show what a brug is capable of looking like. I hope it was entered into the contest.
kell, I agree with you until a certain extent. All of us post our pictures here in davesgarden, BGI or abads so we may all enjoy these pictures. So far, so good.
But my experience is, that these pictures turn up and being sold to publishers under their name, earning a lot of money with the pictures. We do not receive one penny for recoignition and I had to stop quite a few publishers, that tried to place my pictures in their books or magazines.
Selling pictures is a flourishing market!!! many of us dont even know that and that include me also!
I may remind you, that the copyright has been removed by whom soever, which is not correct. When I saw this pictue, I got in touch with these people and Dave to have my picture and apparently, there were more, removed.
