Trades and sales of imported brugs

This message concerns anyone who has Brugmansia imports in their possesion. Those who are trading or distributing even the tiniest cutting from any of these imports are breaking the law. Seeds from these unquarantined plants are illegal too. Your imports have not gone thru the necessary post entry requirements. This includes any imports you've received via Canada. Vicki, you didn't even ask if we have proper papers or not, you just say that we are all lawbreakers, without any qualifications on that statement. That would have to include anyone who also sells these brugs the way you put it!

Any company, persons or individuals intending to import restricted plants or plant products need to apply for an Import Permit from APHIS. This import permit will have a permit number and specified the location where the
intended plants or plant products are to be grown """while under a post-entry quarantine agreement""". The post-entry quarantine growing agreement shall specify the kind, number, and origin of the plants to be imported, and shall
certify to APHIS and to the State in which the articles are grown that """the signer of the agreement will comply with the following conditions for the duration of the quarantine period (24 months for Brugmansia)""".

1-To grow such plants or increase therefrom only on specified premises owned, rented, or otherwise in possession of the importer, within a space of
dimensions designated by an inspector, and to move, propagate, or allow propagation of the article or increase therefrom or parts thereof """only with the written permission of an inspector and only to the extent prescribed by the inspector."""

2-"""To permit an inspector to have access to the specified premises for inspection""" of such article during regular business hours

3- To keep the article and any increase therefrom identified with a label showing the name of the article, port accession number, and date of importation

4- To keep the article separated from any domestic plant or plant products of the same genus by no less than 3 meters (approximately 10 feet): and from any other imported plant or plant product by the same distance.

5- To allow or to apply remedial measures (including destruction) determine by an inspector to be necessary to prevent the spread of an injurious plant
disease, injurious insect pest, or other plant pest

6- To notify an inspector, orally or in writing, within 30 days of the time the importer or the person in charge of the growing site finds any abnormality of the article, or the article dies or is killed by the importer, the person in charge of the growing site, or any other person: to retain the abnormal article for at least 30 following the date of notification; and to give the abnormal or dead article to an inspector upon request.

Eric, I'm really concerned about the tomatoes I grew last year, they were in the same yard as my brugs, and the air blows here. I do wonder how many people have posts here where they traded and should they (we) be concerned that the brug busters are coming just for that variety that we traded, or will they get them all?? Yes, I've been using the anger I'm feeling to pot up some seedlings, but I think now I'll just go dump them all in the garbage, the garbage truck comes this afternoon, and I think I just enough time.
Maybe I can grow marigolds instead this year.

well, we could all just replace our poor now illegal plants with new ones from a nursery that has followed every single rule from the very very very beginning, including never trading. One that's kept all those lovely Euro hybrids quarantined for 24 months. some of those are pretty new, aren't they?

Is this for real????????? I have had the flu since Friday and have just been sitting here in a sick daze reading all these posts.Now I feel sicker. This sound like a horrible scare tactic to me .I believe in going by the law also but this is beyond that.Yesterday was my first day out of the house. Had to go to the store since we were getting a snowstorm but I am too sick to go out to burn my Brugs. So Brug busters, come and get me but remember sick or not I'm putting up a fight for all my Brug babies.

i have no idea if i have an "illegal" plant or not. I do know that everything i have tried to root has rooted, therefore must not have a virus.

tiG, I know it's for real and I abide by the law too. This just seems a little too much especially coming from one of the few growers where it would be "legal" to buy from.Our state motto here is "Live Free or Die".Unfortunately with people putting terror into the minds of innocent Brug growers that just like to grow them because they are a beautiful plant and to share their beauty with others it is getting harder and harder to live up to that motto.

Well it's legal to get seeds into Canada and since I grow most of mine from seed, I guess they are legal. And the ones from Hodnik's all came with phytos, and the ones I'm getting from Tonny are coming with phytos, and Monika's come with phytos. I've only got seeds from LBJ because they don't ship to Canada.

So would someone who knows what he/she is talking about please type up a list of the growers we are legally allowed to buy brug/datura cuttings/plants/seeds from??

And can we order from them without getting permission/forms from anyone?? Not clear on this.

Looks like before long, if we want a brug cutting it will cost up a pretty penny to get a legal one:)

Mine all came with phytos, I have a green house inspection certificate, an import license and also a pesticide applicators license.(wonder if that's enough licenses) Some of my brugs CAME from my inspector. ALL of my brugs have been inspected.
Me thinks someone is jealous because said person got a virus and doesn't have some of the latest hybrids and doesn't want anyone else to have them. Me also thinks said person is a trouble maker.

Ok everyone,let's settle down.Obviously Vicki doesn't want us buying from anyone but her.If you have ordered from overseas just file your phyto certificates and keep them forever.
If anyone intends to sell plants simply make sure you have the proper license and inspections.This is neither hard to do nor expensive.In Florida,the license is under 50.00 for small operators.The inspector will visit your premises often to inspect for pest's and disease.They are always friendly and helpful.He or she will also provide the necessary inspection certificates for shipment within the continental US.I would think that other states would have similar rules.A call to your local Ag extension agent would get you the necessary info.
I see now that trades will have to be done privately,without posting to the forum.I,for one,am going to apply for a new nursery license next week.

Irish, likewise i had one of those things in the 70s. the fuzz did come and pull up my "jewel" out of the yard, guess they enjoyed burning it for themselves..... fortunately they must have forgotten to bother me any more about it, no charges or lectures.

i have been dying to say this, and since i am a mom and haven't done those 70s things for so long, guess i will, but growing brugs brings back those memories of how we used to do that, even down to the tiny little hairs on those pretty brugs.... Pete, you said that it seems Vicki only wants us to buy from her. I disagree. If she really wanted us to buy from her, she wouldn't have come in here accusing all of us. Yes, I think trades will have to be done in private from now on. Not sure yet how we'll work that. But you can bet there will be people working on making trading illegal too.

Owen: Sounds like the cake recipe got around to everyone. LOL I'm thinking it might be time to make a batch.

I seem to have figured out the general issue here, and my opinion is that somebody has their panties in a wad about something. Sure glad I have some nice brugs that people sent me a couple months ago. Now it seems like I have to look out for the Bruggiecops. Ho, hum, if they're gonna put me in jail for THAT, perhaps that means I won't have to pay my taxes this year. That would be wonderful, as our tax estimate was astronomical. I would fight for the brugs, tho. :>)

Is the message that Vicki started this thread with something that she wrote or something that came from information she has received from the brug police? :-) It seems like I read someplace that she got her start doing just what we are doing. I would hope that she would not intentionally try to hurt any of us and our passion for flowers and friends/trading.
