Does anyone know the name of this shrub and if so I am in NJ can I prune now with out hurting the shrub

Your single closeup image makes me think that is a Privet (Ligustrum sp.); it shows opposite arrangement of simple leaves. Those are common hedging and landscape shrubs in the eastern US, and you could run over them with a lawnmower and they'd grow right back.
I think you are fine to prune it now. You could also take some more pics and post them here, so that more information is available for others to offer advice.
