This tree may actually be a shrub because it has several trunks growing out of the ground all grouped together. The leaves start out dark green then change to a deep red pretty quickly in the spring. Even if it is a shrub it still grows upward and out more like a tree. I don't remember any seed pods from last year.

A purple leaf cultivar of either Cherry-plum Prunus cerasifera or a crabapple Malus. Pics aren't clear enough to tell which.

It looks like the plum, thanks. No fruit though though :-( but I guess that is best since we have 3 dogs and don't need them choking on anything. I will take a pic of it in the daytime. I did not have a chance to do that yesterday and just cut off branches of each of my trees and shrubs late last night and held them in front of my laptop cam.
The laptop cam is fine - just use some lighter background than that fine black leather.
