This "bug" seems to hover near the soil in my garden...come out when temps reach about 55...a lot more when sun in out...

It's a bee of some type.
A lot of species dont make hives, and individuals just make a small circular burrow in the ground where they lay eggs, and bring food to their larvae.
Gardens are a perfect place with their loose soil, and clear space.

I agree with LadyAshleyR that it definitely is a bee...and from the looks of it could be what we here in Michigan refer to as a sweat bee. those are generally small, mostly black or brown or red (a few are green) and like to hang around people a little too much when it gets warm and some of the 1000 species living in america like to live in the ground. they're excellent pollinators but are called sweat bees for a reason, they do enjoy the taste of human produced salt which comes out in our sweat. if it's just an individual and not a hive, i'd let the bee be unless anyone in your family is allergic to bees in which case you'll probably want to remove it.

I didn't even think about that, since the picture seems to be blown up a bit.
It could in fact be a sweat bee.
Hate being stung by those little buggers.

Thanks so much LadyAshleyR and aquilusdomini
...will just leave them alone?

Yeah they wont hurt anything.
Even if you get stung, its a very minor pain.
More annoying than anything. Kind of like a paper cut.
