This is an orb weaver (family Araneidae); likely in the genus Neoscona - see http://tinyurl.com/5spd46 for an example. Spiders in this genus ( as well as some in the related genus Araneus) can be quite variable in color and pattern, and therefore sometimes difficult to differentiate in the field.
Definitely an orb.
