If at all possible, try to take another photo from above that shows the wing veins clearly. Otherwise, it may take a specialist in the group to recognize it.
Looks kinda like a snipe fly...larvae like to breed in decaying plant material... need more detail & size perspective; snipes usually 8-15mm
Size is about right, they kinda look like skinny bees when they fly....Greg
I seriously doubt that this is a snipe fly (family Rhagionidae), but I really need to see the wing venation clearly. This fly is annoyingly familiar, I know that I have seen it before; I just can't put a name on it at the moment.
Garbage is gone & bugs are gone, I have no other pics. If I see them again I will try for a better pic. Greg
Aha - I think that I finally have it - I believe that this is a soldier fly (Diptera Stratiomyidae) in the genus Ptecticus - see http://tinyurl.com/lp4xme for an image. These flies often are found aggregating around rotten fruit and fungus; sometimes compost piles as well; their larvae feed on decomposing organic matter.
