That's an odd looking Indian Hawthorn (the leaves look too small). It reminds me more of a Japanese Holly or a dwarf Viburnum obovatum. Anywho... I'd make sure that the mulch isn't piled up too high in the center and/or that the area drains sufficiently because it looks a lot like stem rot.

Also, I included a close-up of an indian hawthorn (Rhaphiolepis species) to show you what a standard one looks like.
