Beginner Gardening: Transplanting a California Pepper tree, 1 by roostergooster

My gardener planted a California Pepper in my back yard it was very large in a 42 x 42 container it needed to be craned to my back yard. We had a very hot spell the week after it was planted and I think it did not get enough water. It has now been 6 weeks. All of the leaves turned brown with in the first two weeks but they have not fallen from the tree. It looks dead to me but my gardener assures me it is not. Are these trees hardy? What are the odds it will come back? Any help here would be much appreciated.
