Okay - I thought maybe a swainson's warbler
But I think you are right - I need to watch for the eye if I see him again. I have a lot of trees around my observation area and with the low light it sometimes changes the birds coloring a little bit.
Well, my opinion is that it has a very heavy beak for a warbler. The darkness of the photo makes it hard to know if the colours are true (I think not).
I'd agree with Swainson's - the bill is long and sharp-pointed (Swainson's does have a large bill as warblers go), whereas R-eV has a bill with a distinct hooked tip (a bit like a small shrike's bill). Also the supercilium (eyebrow) is yellow-buff, not white, and has a black lateral crown stripe. Finally, the legs are pinkish - right for Swainson's, not for R-eV (dull blue-grey).
