can you help with the legal end?

I'm growing some rather unique hot peppers called datils. They are only grown commercially in the St. Augustine, Fl area. Question is, would I be in trouble with the FDA if I grow them, harvest them, dry them, crush them into flakes, and then sell them in those little spice shaker jars? I was hoping to sell thru eBay.

You might check with your local county extention - depending on how small scale you are, you might not fall under as many rules and regs - on the other hand, they may require you to process in a comercial kitchen... good luck!

I think the only way you'd have trouble with the FDA would be if you made some kind of medical claim regarding the product. But I'd check with the local ag. extension agent and with whoever in FL issues business licenses (in TX it's the comptroller of public accounts). It would depend on how much you anticipate profits to be, etc., but since it's something people would ingest there might be more to it. Poke around your state website and see if you can find anything, or ask someone who runs a little herb shop or farmer's market around your area.
