Stolen Photos ...ideas to prevent?

Coal Center, PA(Zone 6a)

In the past weeks I have come upon 4 of my DG photos [copyright cropped] taken to sell others' items.
2 are at Ebay. And 2 taken by businesses.
It was disheartening to come upon used like that.
And has me wondering how many more of mine and others here are out there taken like this.

I started putting my name right on the flower after the first to try to prevent.
But my guess is that can be removed if really wanted ..as one photo was flipped besides cropped to hide it's identity further.

Any thoughts on what to do? How to prevent?
I will appreciate input.
Thanks (o:

That's terrible! I'm so sorry that people would be so dishonest not ask your permission first before using your pictures and then manipulating the photo to suit their own interests!!!

Have you posted the same thread at Dave's forum? Please make him aware that your pictures have been stolen from DG. If your photos were taken without authorization, perhaps, others were too.

Newark, OH(Zone 5a)

I would ask Dave on what to do also. This is not a good thing :(

San Leandro, CA(Zone 9b)

shoot. I forgot to click the copyright button on mine again, but then again I guess it does not matter if they are taking it off. too bad, it takes away from the photo. Maybe if you let ebay know they would talk to dealers about using stolen images.

Marshfield, MO(Zone 6a)

If you are posting them here on DG, there isn't much you can do to prevent theft of the images. Javascript can be put into webpages that prevent right clicking, but anybody who knows much can just view the code and see the location of the image and cut and paste it directly into their browser to get the image. There are programs to scramble your html code to hide that, but it can't be implemented on a forum, so you are pretty much out of luck. The best thing to do is to mark your images with a large clear embossed copyright, such as that attached, which is more difficult to edit out.

I agree with Mary, that's about all you can do. If you have paintshop or something it's easy to put into a transparent layer, but hard to remove.

Westbrook, ME(Zone 5a)

Alice, it's happened to me too. http://davesgarden.com/t/291871/ Let Dave know.

rural, WY(Zone 3a)

If it was taken from Daves, doesn't that mean it was a member?

Harrisville, MI(Zone 5b)

What about putting your photos in the second post of your thead?then only members would have access to it.

Brugvalley, Germany(Zone 7b)

I think some members do it,too. I have seen some of my pictures somewhere over...

Westbrook, ME(Zone 5a)

Over where Ludger??
If the images are in the database anyone can view them.

Brugvalley, Germany(Zone 7b)

Sorry, I have seen it, have become angry and forgot where I have seen the pictures.
If people must steal my pictures, there must be a reason :-)
my friends will recognize them one day.
People who will steal pictures are not good ones. I dont watch them.

Newberry, FL(Zone 8B)

Ludger, you should email them and ask them to take them down if you don't want them shown.

Brugvalley, Germany(Zone 7b)

Arlene, you are right.

I miss the time...

Murfreesboro, TN(Zone 7a)

Alice, please email Dave or me with the websites/eBay sellers where you found your images. We are zealous about guarding the copyrighted images that you post in good faith to the PDB, but we simply don't have the resources to constantly scan the horizon for stolen images. Letting us know is the first step to getting them removed from those sites.

I wish we lived in a world where people didn't brazenly steal images :(

Brugvalley, Germany(Zone 7b)

I am not Alice..but thank you very much,Terry, for caring!!!

Tulsa, OK(Zone 6b)

Alice started the thread, Ludger. If you find where your pictures were posted, do the same thing and let Terry or Dave know where they are. I found one of tiG's pictures on ebay a month or two ago, and wrote her to tell her about it.

Brugvalley, Germany(Zone 7b)

Sorry...

Norwalk, IA(Zone 5b)

Contact the individuals and tell them to remove YOUR pics..if that doesn't work then contact Ebay and tell them. They can do something about it.Seperate business's using your pics...contact the seller and tell them you WILL contact the state attourney generals office to get something done.If that doesn't work email their web site a virus!!LOL just kidding on the virus part.....;-)

San Leandro, CA(Zone 9b)

I probably wouldn't mind them showing my photo if they gave me credit for it in great big 72 pt font! LOL

ummm---:( I took a lovely brug pic n used it for my desktop once------not sure whos it was, but it was a stunning yellow loaded to the ground and ummm well its still there---wish i could remember whos it was so I can tell everyone who walks past my comp and gasps---"so and so" grew that---yes there are ppl who use photos to make money and darnit they never send a thank you let alone a little money to buy MG, but you have got to admit---its pretty flattering...hope no one is offended that I 'stole" a photo--but it was like sneakin in some sunshine during the winter. cheryl

If one does a yahoo or goggle search, Davesgarden threads often come up. Anyone could take your photos, so its not necessarily a person who is a member here.

Murfreesboro, TN(Zone 7a)

Ludger, no need to apologize - I did direct my comments toward Alice/Abutilon, as she was the one who first broached the subject. But it holds true for anyone who has experienced this problem.

And I do agree that the first thing to do is to take the initiative to contact them yourself - as the image copyright-holder you are well within your rights to demand they remove it. Some businesses won't take an individual's request as seriously as they will a demand from another business, and we can step up to assist when that happens.

As far as using an image for your own screensaver; it doesn't fall under the same rules. Downloading an image for your own personal use is not generally considered copyright infringement (the music industry debate notwithstanding, as photographers don't receive royalties as musicians do.)

Posting someone's images on your website, publishing them in any media (book, magazine article, slideshow presentation, etc.) consitutes copyright infringement if you don't obtain permission first, AND give credit to the photographer and the source.

pssst---kell---if it offends you---*cuz its your yellow monster brug* Ill take it off, but you have to understand--it gives me hope---it inspires me to fertilize sometimes twice a day lol and ummm Ill prolly cry too. keep telling hubby "seeeeeeeeeee? thats why i have this obsesive compulsive brug disorder." cheryl

I am flattered Play......... go for it! Doubt it will help with your DH though, they will never understnad!

Brugvalley, Germany(Zone 7b)

Thank you Terry :-)

I will have a look ( watch ) where I will see my pictures again.

One of my early pics is in use by a French company..I emailed them several times..but no change and no answer.

Orange Park, FL(Zone 8b)

It's very distressing, I know & just the reason, I decorate many of mine up. They HAVE to work harder to remove many 'merged' layers. Or so I was told...plus, some I add digimarc to, which can be read with a tool. Hope that helps somewhat.

WOW Lady Swan! What program do you use?

Well, I for one am not going to get in a bunch over this! It is not like I am going to print them in a book. I take lots of time to make my pictures and the more people who see them and hopefully enjoy them the more I should be happy! It would be nice if they gave me credit for them. Of course no one has stolen my pics.......so I guess I should not be so presumptuous that any one even wants them!!

Newnan, GA(Zone 8a)

kell, your pictures are beautiful. I'm sure they are on many wallpapers over the country.

Coal Center, PA(Zone 6a)

I have really appreciated all the input here.
Kell and others, I'm sure your good photos will turn up somewhere.

One seller has been using my 'Primrose Yellow' photo for months taken from either PDB or our canna site
(copyright cropped and renamed her canna to suit needs). Finally stopped now after I bid on the item. ha

The cropped and flipped photo was taken from our canna site by a business. I have asked removed.
The others either I knew or seemed innocent enough I let pass.

But anyone who posts photos might want to pay attention where photos are used.
It was a 'shock' for me to find my own photos staring at me. lol
Especially the 'doctored' ones. ha

San Leandro, CA(Zone 9b)

I can see where you would be upset after all you have a business! Also if someone was using it to rip people off like that ebay guy who used that brand new fancy pink from a french brug site and said he was selling it. he was getting like $50 per listing. What a rip!

Thanks tig.

I had a very bad experience when I was selling seeds on e-bay. A gal bought seeds from me... and turned around and sold them at 5 times the price ... with photos she stole from my auctions. On her auction descriptions, there was a link to her "business" page where she sold all these "RARE" and "NEVER BEEN SEEN BEFORE" poppies. When I clicked on her page it was like a pictorial of my flowers & my garden. She had taken every poppy photo I had ever listed on e-bay. You could even see my house in the background of "her" fabulous poppy garden. I tell ya... I was fit to be tied. I was ready to drive out to Colorado and ring this girls neck!

Lady Swan--I want my hoya to bloom. WAH! (sniffle)And I luv the pixie twinkle/tinkerbell flying around your bloom. Maybe thats the secret to the blooms *GRIN*

Alice- I always look for your pics on ebay to try and bid (when my phone lines are up..grrrr) I always look for your member name now I really don't know the others-- except Barbara and Nestor. I reported one of the people selling a plumeria on ebay to the nursery that had the rights to the image. They have a notice right on their website about going after the culprits. The other thing I don't know who the webmaster/webhoster is for the businesses are but you would think they would be afraid of using misappropriated images.

Orange Park, FL(Zone 8b)

Kell, looked at many of your pictures & agreeing with the others here. More than likely they are being shared!
I don't mind if a person would use a picture of mine...
but, one should ask & not claim it as thiers! that is sad & stealing, especially if they are making a profit.
Most of mine aren't worth stealing tho, a lady did take it upon herself to use a few.

Kell, I use several combined...picture it, photoimpact & PSP. Having fun trying to learn new things :)

San Leandro, CA(Zone 9b)

That is outrageous Sue!! Did you report her to ebay? I doubt they want the bad press. I do not got to ebay much anymore, I was ripped off one time too many!

Orange Park, FL(Zone 8b)

Oh my gosh poppysue...I remember seeing that on ebay! Those were your pic's? I was looking at them as a gift for my momma.

Desert Rose, I think my hoya blooms because, I ignore it!
Back in 98 a lady told me, I was pampering it to much, so I took her advice.

Westbrook, ME(Zone 5a)

This was about 5 years ago. Before DG days. I reported it to e-bay and her auctions were promptly shut down. She picked up and moved her auctions over to Amazon... and then Yahoo. It wasn't as easy to get her ISP to shut down her web page. I had to fax the negatives of the images to them in order to prove they were mine. Eventually they shut her down.

It doesn't take much to ask for permission. I've had loads of people ask because of all the photos I add to the database. I've never refused anyone permission. If this gal had asked me it would have been a whole different story.

Vancleave, MS(Zone 8b)

Good for you Poppy. I have given premission to a couple of people also mostly for educationlal purposes especially my bird pics. I also had a lady buying my large packs of datura seeds cheap and selling for 5 x's the price to. I had people bidding on hers and not mine. I guess it's all in how you word the add. I think I would buy 60 double purple datura seeds harvested in the fall of 2002 for 3 dollars before I paid 3 dollars for 10 with no mention of the age of the seeds.
