okay, snowbank question

pebble got me to thinking. If Abutilon has seeds in the seedpods of her Snowbank, and this is what Cala posted about the patent law: "They begin with the issue of the patent and can continue up to 20 years, some are only 17 years.
This was copied from the US plant patent act of 1930, from Dave Wilson's site:
Asexual propagation of patented plants (including any of its parts such as leaves, buds, cuttings, seed, fruit or pollen) is strictly prohibited without the written authorization of the patent holder or the patent holder’s agent. Possession of improperly propagated trees of patented varieties (such as the receipt of trees, budwood or graftwood from unauthorized sources) constitutes infringement, even if an illegal propagation was inadvertent."


then what happens to Alice's seeds and resulting babies? She didn't even cross it on purpose (I'm trying to remember, let's just say for arguement she didn't)

Probably she will have to notify the patent holder about the pod and its up to them, if she can keep the pod and what should happen to the seedlings.

I believe that Abutilion was given permission anyway & even encouraged by Tara Nova to propagate Snowbank. I'd hope that would include setting seed pods to it.

What if the seedpod splits open, and the seeds fall upon fertile soil and come up by themselves...?

What if they grow into double pinks with pure white edged leaves of great substance?

What about PPAF hostas which need division? Must we tolerate them regardless of whether the clump threatens to take over the house?

Am I missing something here? It says "Wilson's site:
Asexual propagation". Her seed pod was made thru sexual propagation ...........wasn't it??? The old fashion way when an anther makes whoopie with the stigma. Since seeds do not come true to the parents, sexual propagation is not covered. And they could not anyway, bees do not read and there are no itty bitty bee jails I know of...... well, at least that is what make sense to me. So explain to me how my thinking is so blonde........LOL!

You DO have a way with words, Kell. Boy have I been dumb, didn't know all that, and I am not blonde....

I have propogated roses for years and gave starts away. They are better than grafted roses, as they can't freeze past the "graft", which is not there on a cutting. No one has arrested me yet, but it may happen after I've told this on DG!!!

A cutting is a clone, therefore asexual propagation. I would take asexual to mean any method other than seed. Restrictions of use of pollen is another issue, probably not worth addressing.

Using the pollen from a protected Plant will give a new hybrid to You.Not protected by the "C" from the old hybrid.
Same if you get seeds from the protected hybrid( you have new seedlings, NOT reproduced the "C" plant.
The seedlings you can protect by your own.

Gloria Dei is the most sold rose all over the world, it is protected but you can use pollen and seeds by your own.

I need to make clear on some of the above.
Except for Kell's post ..not touching that one! .. LOL

1.) Snowbanks I grow are Terra Nova stock. I do not have permission to propagate.
I do not/have not propagated clones. And I tell others they should not.
What they decide on their own, I am not part.
2.) On my largest Snowbank ..2 pods were manually pollenated.
And 2 pods were the result of "whoopie" in the greenhouse.
In bud again, I will experiement if off chance Snowbank could self pollenate.
3.) I did inform the patent holder about the pods ..because I thought he might like knowing.
Always interesting to see where your 'creation' goes. I would be interested!
4.) Maya ..from which Snowbank came ..most seedlings are white that die 2nd leaf.
I am curious to see if Snowbank seeds even germinate, white, or what?

As I am always asked whether I know Abutilon? .. lol

Well, I do not know about yours Brugie, but my brugs are not devoid of sexuality, in fact just now when I made my after work round I found lots of new pods forming so I think my yard might actually be a den of iniquity in the nighttime hours.

Alice, I can't wait to see what you get from your seeds!
