I think this is some sort of fly. The photo was taken on July 11, 2015 on Chicago on the Weber Spur Trail, an abandoned railroad right of way.

It's a fruit fly (family Tephritidae) in the genus Paracantha - see https://en.wikipedia.org/wiki/Paracantha_cultaris for an example.
