I've never seen one of these birds before, and it appears to have an injured foot. It looks like a hawk, but is much, much smaller than any hawk I've ever seen before. I did a little digging and the size appears to match a Merlin, but I'm not sure about markings, whether they are in this region (San Jose, CA) etc. Any ideas? Thanks in advance!

It could just be standing on one leg (they often do), nothing in these photos to prove it is injured.
