CLOSED: What bird is this?

This bird seemed to big to be a black and white warbler, but I can't think what else it could be. Maybe it wasn't as big as I thought?

This bird was nearby but it's not the same bird as in pic 1. It was in a tree full of little birds. One that I saw through binocs was a black and white warbler. Not so sure about this one though. He just looks weird. Maybe it's b/c he's upside down.
