Cant figure it out here. I,m not sure but is that a band on its upper right leg?
Took a second look in more detail; coming up with a bit of a surprise answer: Black-and-white Warbler.
The key is the black spots on the under tail coverts - no other new world warbler has them, they are diagnostic for B&WW. The orangey-yellow wash is I guess partly due to light conditions, partly due to its (probably) being a juvenile.

Those spots on the under-tail coverts is what made me give up...now noted. Props!
I saw several black and white warblers in the same area so that makes sense although I never would have gotten it from that picture. Thanks!
