It looks like a Wood Thrush to me...but someone with more experience will be able to tell you.
Not sure but agree that it is from the Thrush family. I wanted to say juvenile Eastern Bluebird because they have an eye-ring as juvenile's... but the beak seems too long so maybe someone else can give an Id.
I thought about the bluebird but considering how high up it was it seemed bigger then the adult sitting on the powerline below.

When was the pic taken? The leafless tree rather suggests winter, in which case Hermit Thrush is more likely

Well if an adult Eastern Bluebird was below its quite possible it was a juvy EB. When I think I come across a new bird, I try to spend as much time with it as the bird allows, and take multiple photo's. Another photo may have shown the beak to be more proportionate to an EB.
Resin, I read the exif data (have a Firefox add-on) it says 6-28-10 for date taken.
I don't think were going to get a 100% Id out of this one...best to keep an eye out though, if it was in your tree maybe it will return.
I'd go with juv. Eastern Bluebird . . . we know well from 2dCousinDave's pics and others that the fresh juvs do look bigger and fatter than their parents (probably more fluffy feathering)
