CLOSED: Kestrel?

This bird was soaring at a couple hundred feet or so, small bird, my field guide didn't help when comparing flight/wing patterns to Kestrels and Merlin's. 4 shots only cropped.

Sharp-shinned Hawk - wings too broad and rounded for a kestrel

No neck and squared tail says Sharpie to me too.

Ok Thanks! I forgot Sharp-shinned Hawks, are not much bigger than some Kestrels.
