I looked hard at the tail feathers and think I see a mixture of white and black. But the beak is shortish and that's why I think both snaps are of a Downy Woodpecker. This snap shot was taken 8/2/09.
Am I correct?

PS, I don;t think they are the same bird, notice the red on the back of the head of the second photo.
But I still think both are Downy's.

Yep, Downy Woodpeckers. Note the small black spots on the white edge of the tail - Hairy has pure white edges.
Red on the back of the head means adult male, no red is adult female, and red at the front of the head is juvenile (both sexes).
